Q. Is an employer required to post a schedule so that I know when I am supposed to work?

A. Every employer must notify the employees of the time at which work starts and ends by posting notices where they can be seen by the employees. Schedules must be posted at least 24 hours prior to the start of the schedule.

Q. Can an employer change my schedule even though it was posted for a set period of time?

A. Yes, it's important to remember that labour demands do change for employers based on business. However, if employers are making changes to posted schedules, they must provide employees who are affected by the changes with written notice.

Q. Can an employer require that I work with less than 24 hours notice of shift change?

A. No, if you have other commitments (such as another job) that do not allow you to work then you are able to refuse work with less than 24 hours notice.

Q. Can an employer terminate my employment because I have refused work with less than 24 hours notice of shift change?

A. If you are terminated for this reason, this would not be considered JUST CAUSE and you would be entitled to termination pay based on your length of service. Call the Jasper Employment & Education Centre for more details.

Q. Can an employer deem that I have quit due to my refusal of work with less than 24 hours notice of shift change?

A. No, you do have the right to refuse work with less than 24 hours notice.

Q. If the employer terminates my employment but marks down on my ROE that I have quit, what should I do?

A. Contact the Canadian Revenue Agency at 1-800-206-7218 to report the incorrect information on your ROE. It will be important to do this in order to ensure that the insurable hours you have worked may be considered towards your next EI claim.
